Terms of Service
These terms govern your use of the Picksmith Android app and the picksmith.app website (together, the “Service”). By using the Service you agree to these terms. If you do not agree, do not use the Service.
1. The Service
Picksmith is a guitar-practice application providing tools such as a tuner, scale and chord finder, ear training, metronome, backing tracks, and a progression builder. We may add, change, or remove features at any time.
2. Your account
You can use most features without an account. If you choose to sign in (via Google, Facebook, or email) you are responsible for keeping your sign-in credentials secure and for activity performed under your account. You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to create an account.
3. Subscriptions and payment
Pro features are offered on an auto-renewing subscription basis through Google Play Billing. By starting a subscription you authorize Google to charge the payment method on your Google account at the start of each billing period.
- Renewal — subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period.
- Cancellation — cancel at any time from Google Play → Subscriptions. You keep Pro access until the end of the period you have already paid for.
- Free trials — if a free trial is offered and you do not cancel before it ends, you will be charged for the first subscription period.
- Refunds — refunds are handled under Google Play's refund policy. Consumers in the EU/EEA retain statutory withdrawal rights as described below.
4. Statutory right of withdrawal (EU/EEA consumers)
If you purchase a subscription as a consumer in the EU/EEA you have a 14-day right of withdrawal starting from the day of purchase. Because the Service is digital content delivered immediately, by starting to use Pro features during the 14-day period you expressly consent to immediate performance and acknowledge that your right of withdrawal may be lost. To withdraw, email support@picksmith.app.
5. Acceptable use
When using the Service you agree not to:
- Reverse-engineer, decompile, or attempt to extract source code, except as permitted by law;
- Use the Service to build a competing product;
- Upload or transmit content that is illegal, abusive, harassing, or infringing;
- Circumvent paywalls, rate limits, or anti-fraud measures;
- Use the Service to harm, harass, or impersonate other users.
6. User content
You retain ownership of the progressions, repertoire, notes, and other content you create in the app (“Your Content”). You grant us a limited, worldwide, royalty-free licence to store, sync, and display Your Content strictly for the purpose of operating the Service. We do not use Your Content to train AI models, sell it, or share it with advertisers.
7. Intellectual property
The Picksmith app, website, brand, and associated materials are owned by the developer and are protected by copyright and other intellectual-property laws. Third-party libraries are used under their respective licences, listed in the app's Settings → About → Open-source licences screen.
8. Disclaimer of warranties
The Service is provided “as is” and “as available”. To the maximum extent permitted by law we make no warranties — express or implied — regarding availability, fitness for a particular purpose, or uninterrupted operation. Music-theory information presented in the app is provided for educational purposes and may contain errors.
9. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages. Nothing in these terms limits liability that cannot be limited by law (including consumer rights in the EU/EEA).
10. Termination
You can stop using the Service and delete your account at any time from Settings → Account → Delete account. We may suspend or terminate accounts that violate these terms or that must be suspended to comply with law, with notice where practicable.
11. Changes to these terms
We may update these terms from time to time. Material changes will be announced inside the app and the “Last updated” date above will change. Continued use of the Service after an update means you accept the new terms.
12. Governing law
These terms are governed by the laws of Iceland. Any dispute arising out of the Service will be brought before the courts of Reykjavík, subject to any mandatory consumer-protection rules in your country of residence.
